1. Agreement to Terms

By accessing or using learnaiwithliam.deskcush.com (the "site") or booking 1:1 AI coaching ("services") with AI with Liam, you agree to these Terms of Service. If you don't agree, please don't use the site or services.

"We", "us", "our" refer to DeskCush Ltd, a company registered in England and Wales. "You" refers to the user of the site or client of the services.

2. The Services

AI with Liam provides 1:1 virtual AI coaching sessions for individuals and small businesses. Sessions are delivered live by video and last approximately 60 minutes. Available formats are described on the site (Foundations, Performance, Bundles, Founder packages, ongoing support tiers, etc.).

Outcomes from coaching depend on your engagement, your starting point, and the topics chosen — we do not guarantee specific business or financial results.

3. AI Assistant on This Site

By using the assistant, you accept that:

• Replies are informational only and not professional, legal, financial, medical, or regulated advice.
• We make no warranty that the assistant's replies are accurate, complete, or fit for any specific purpose.
• You will not submit sensitive personal data (health, financial, identity, passwords, payment details) or third-party personal data into the chat.
• Conversation messages are processed by our sub-processor (Anthropic) — see the Privacy Policy.
• Decisions you take based on the assistant's output are your responsibility.

4. Booking and Payment

• Sessions can be paid for upfront via Stripe links shown on each session card, or invoiced after an enquiry.
• Bundles and multi-session packs are billed in full at the point of purchase unless otherwise agreed.
• All prices are in GBP. UK VAT is included where applicable; for invoiced clients, VAT (if any) will be itemised separately.

5. Rescheduling and Refunds

• You can reschedule a session up to 24 hours before the start time at no charge.
• Sessions cancelled with less than 24 hours' notice, or no-shows, are non-refundable.
• For unused sessions in a bundle, refunds at our discretion within 30 days of purchase.
• Subscription support tiers can be cancelled at any time; you will retain access until the end of the current billing period and will not be billed again.

6. Acceptable Use

When using the site or services, you agree not to:

• Attempt to break, probe, or reverse-engineer the assistant or backend.
• Use the assistant to generate content that is unlawful, harassing, or infringing.
• Submit personal data of third parties without their consent.
• Resell or repackage coaching session content without written agreement.

We reserve the right to suspend or terminate access if these terms are breached.

7. Intellectual Property

The site, its design, copy, frameworks, and any worksheets or templates we share with you remain our intellectual property. You receive a personal, non-transferable licence to use materials shared in your sessions for your own work and learning. You retain ownership of anything you create yourself during a session.

8. Confidentiality

We treat the contents of your sessions as confidential. We won't share specifics of your business or your questions externally, except in anonymised, aggregate form (e.g. anonymised case studies). If you'd like to opt out of even anonymised mention, just say so by email.

9. Logging Notice

Standard server logs (timestamps, IPs, request paths) may be retained by our hosting and infrastructure providers for security, abuse prevention, and debugging. The chat widget itself does not store conversations on our servers — see the Privacy Policy for the full picture.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to your use of the site or services shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for outcomes you base on the AI assistant's replies.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by UK law.

11. Termination

You may stop using the site at any time. We may suspend or terminate access if these terms are breached. Termination does not affect any rights or obligations that have already accrued.

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We may update these Terms occasionally. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the site or services after changes are posted means you accept the updated Terms.
